Legal Services

  Divorce Mediation

If you wish to pursue settlement of a Divorce, Legal Separation, or Dissolution of Domestic Partnership, I suggest that you schedule a consultation for Family Mediation, even if only one party is available. Often the ultimate cost is far less than a contested dissolution matter. The initial consultation of 45 minutes is $100 and you are welcome to return with your spouse for a complimentary follow-up.

  Medicaid Counseling

Long-term care (i.e. in-home, Assisted Living and Nursing Home) is expensive, ranging from several thousand dollars monthly to over $12,000 monthly. Medicaid will pay for long-term care for eligible applicants, however, there are strict income and asset limits for approval. Complicating the matter are financial considerations of a spouse, child or partner. I focus on Emergent Medicaid Planning - adjusting countable assets and income to minimize asset spend-down and preserve as much financial security as legally permitted for non-applicant family members. For clients with transportation difficulties, I offer a no-extra-cost home or hospital visit.

  Last Will & Testament, and Estate Administration

A Will not only provides peace of mind to the Testator and reduces stress for surviving family, transfers of assets by Will may have capital gains advantages by a "step-up" in value. I collaborate with Andrew P. Van Hook, CPA, EA, MST, NTPI Fellow of Van Hook, Robinson, & Co., LLC with regard to tax matters, including Estate Planning and the preparation of the Inheritance Tax Return. A separate Engagement Letter for Mr. Van Hook will be offered for direct accountant services.

I charge a flat $250 fee for a Will consultation and preparation of a simple Will. The cost to prepare Wills with Testamentary Trusts or Guardianships will be higher. For clients with transportation difficulties, I offer a no-extra-cost home or hospital visit.

  Powers of Attorney

A Power of Attorney is a legally-recognized authorization document allowing a designated agent to act in your name on a defined scope of transactions from the time it is signed and for as long as you are competent to act on your own. A Durable Power of Attorney remains valid if you become incompetent to act on your own, and a Springing (a/k/a Triggering) Power of Attorney will only become valid if you become incompetent. I charge a flat $250 fee for a Power of Attorney consultation and preparation of a general Power of Attorney. In combination with a Will consultation, I charge an additional $100 to draft and finalize a Power of Attorney. For clients with transportation difficulties, I offer a no-extra-cost home or hospital visit.

  Advance Healthcare Directive (Living Will)

A Living Will is a legally-recognized authorization document allowing a designated agent to implement your end-of-life decisions set out in the document if you are unable to do it yourself. End-of-life decisions range from "take all measure to prolong my life" to "do not resuscitate" or "do not artificially extend my life if there is no hope for recovery". I charge a flat $250 fee for a Living Will consultation and preparation of an Advance Healthcare Directive. In combination with a Will consultation, I charge an additional $100 to draft and finalize a Living Will. For clients with transportation difficulties, I offer a no-extra-cost home or hospital visit.

  Family Representation and Advice

The potential scope of issues in any Family Law case is very broad - sometimes legal advice at a one-time consultation is sufficient to help a client manage a domestic dispute or arrange a separation, and sometimes a multi-day trial is necessary in a custody trial.

Mr. Zachariasevych is available to consult on issues involving parties' rights prior to, during and after a marriage, intimate relationship or domestic partnership. If a settlement is a possibility, consider Family Mediation. If you have reached an agreement or drafted a settlement agreement, Mr. Zachariasevych is available to prepare or review agreements, and consult on an individual's rights. If an Order or Judgment has been entered, he is available to consult on enforcement or modification as well as emergency matters involving children.

Mr. Zachariasevych has an extensive Family Law practice in "post-judgment" matters, for individuals who have lingering issues after Divorce and Dissolution of Domestic Partnership, individuals who were unsuccessful in getting their point across to the Judge, or who need to return to Court because circumstances have changed. Mr. Zachariasevych is often called upon to address the "hotly contested" issues involving family members or close relations.

Mr. Zachariasevych principally appears in Cumberland, Gloucester and Salem County Courthouses. In certain circumstances he will represent clients in counties farther north or south, however, if cost is a primary consideration, it may be cost effective to hire an attorney local to that Courthouse. Mr. Zachariasevych is also a Family Mediator, and has participated in Family Mediation, on behalf of clients.
